These terms govern your use of elitemedia.studio. By using the site you agree to them. They don't cover the paid service relationship — that's handled separately in the signed Client Agreement for each project.
The entity
behind the site.
1.1 The Site is operated by DPSydney Pty Ltd (ABN 74 682 192 650) trading as Elite Media Studio (EMS), a visual content studio based in Inner South-West Sydney, New South Wales, Australia.
1.2 These Terms govern your use of the Site. They do not govern the service relationship that arises when you engage EMS for photography or video — that relationship is governed by the Client Agreement signed for each project.
By using the site,
you agree.
2.1 By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.
2.2 We may update these Terms from time to time. The current version is always the one published at elitemedia.studio/terms. Continued use of the Site after changes constitutes acceptance of the updated Terms.
Everything on the
site is ours.
3.1 All content on the Site — including images, video, text, logos, design elements, and the underlying code — is owned by EMS or used under licence. All rights are reserved.
3.2 You may view the Site in a browser. You may not copy, reproduce, republish, download, or scrape any part of the Site without our prior written consent, other than for standard browser caching or genuine non-commercial personal reference.
3.3 This is particularly important for photographic and video content. Any unauthorised use of images or video from the Site — including screenshots used in advertising, social media posts, or derivative works — is a breach of these Terms and potentially an infringement of the Copyright Act 1968 (Cth).
Don't do
any of this.
4.1 You must not use the Site to:
- Scrape or harvest content at scale, including via automated tools.
- Train machine learning or AI models on any content hosted here, except where explicitly permitted by our llms.txt file or a signed agreement.
- Reverse-engineer, decompile, or interfere with the Site's operation.
- Impersonate EMS or misrepresent any relationship with us.
- Use the Site in any way that breaches Australian law.
External sites
are theirs, not ours.
5.1 The Site may link to third-party websites (e.g. Instagram, our client portal, payment processors). We are not responsible for the content or practices of those sites. Use them at your own risk under their terms.
What we can
& can't promise.
6.1 We provide the Site "as is". Information on the Site is general in nature and may change without notice. Prices and package details on the Site are indicative; binding pricing is confirmed in a signed proposal.
6.2 We do not promise the Site will always be available, uninterrupted, or free of errors. We reserve the right to modify, suspend, or discontinue any part of the Site at any time.
Nothing in these Terms excludes rights or remedies you have under the Australian Consumer Law that cannot be excluded by contract. Where any part of these Terms would be void or unenforceable under the ACL, it is severed to the minimum extent required and the rest of the Terms continue in force.
Limits on our
liability.
7.1 To the maximum extent permitted by law, EMS is not liable for any indirect, consequential, or incidental loss arising from your use of the Site. This includes loss of profit, loss of data, loss of reputation, or loss of opportunity.
7.2 Where liability cannot be excluded, our total liability is limited to an amount equal to the fees (if any) paid by you to EMS in the 12 months prior to the claim arising.

9.1 These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
